Agreement

The agreement between buyer and seller consists of the information sellers provide about the purchase in the online store (including, among other things, information about the item's art, quantity, quality, other properties, price and delivery conditions), any direct correspondence between the parties (e.g. e-mail) as well as these sales conditions .

In the event of a conflict between the information the seller has provided about the purchase in the online store, direct correspondence between the parties and the terms of the terms of sale, direct correspondence between the parties and the information provided in the online store takes precedence over the terms of sale, as long as it does not conflict with binding legislation.

Agreement conclusion

The agreement is binding for both parties when the buyer's order has been received by the seller. One party is nevertheless not bound by the agreement if there has been a typographical or typographical error in the offer from the seller in the ordering solution in the online store or in the buyer's order, and the other party realized or should have realized that there was such an error.

Prices

The prices, which are stated in the online shop, include value added tax if the buyer does not choose to display prices without being registered as a user from a country outside Norway. Information about the costs the buyer must pay, including value added tax and delivery costs (freight, postage, invoice fee, packaging etc.) as well as specification of certain elements in the total price, is given in the ordering solution before the order is placed. (Deliveries of goods to abroad, Svalbard or Jan Mayen must be sold without the addition of value added tax.)

Payment

The payment methods are: VISA, MasterCard, American Express, Vipps and Klarna. If you as a customer pay by card, the purchase price will be charged the same day. When paying via Vipps, the amount will only be reserved until the order has been processed and shipped from stock. When paying via Klarna, you have 30 days to pay the invoice from the date we process your order.

Delivery

The delivery time for goods that are in the main warehouse or in ready-to-print format is normally 1-4 days (depending on where in the country the product is to be sent). If products are in high demand, longer delivery times may occur. When pre-ordering, we will state the earliest and latest delivery date for the individual item.

Galleri Fint is responsible for the item until it is delivered to the customer.
The customer himself is responsible for collecting the goods at any post office and if they are not collected within 14 days, the corresponding shipping will be charged back to the customer. It is also the customer's responsibility to call for the item if it has not been received within the expected delivery time. The customer is responsible for providing the correct delivery address - and is responsible for paying shipping (both ways) if the item is returned to us due to an incorrect or incomplete address

Production time

Posters and prints that are not original or signed by the artist are printed to order. This means that after you have placed an order, we print products for you. Normal production time is 1-4 working days. Delivery time after production is normally 1–3 working days. Delivery time may be affected by where you live and public holidays/public holidays.

Risk

The risk for the item passes to the buyer when the item has been taken over by the buyer in accordance with the agreement. If the delivery time has arrived and the buyer fails to take over an item that has been placed at his or her disposal according to the agreement, the buyer still bears the risk of loss or damage due to the characteristics of the item itself.

Returns

Right of withdrawal - 14 days open purchase

It is the Cancellation Act that regulates the buyer's and seller's rights and obligations if the purchase is canceled.

If you, as a customer, regret your purchase from us, this must be reported within 14 days after the item has been received. For the right of withdrawal to apply, it must be returned in the condition the customer received and within a reasonable time. The customer is responsible for the risk of return transport and must cover any costs in connection with return shipping.

Some important points from the Right of Cancellation Act:
• The right of withdrawal stipulates that the customer bears the costs themselves (cf. Right of Cancellation Act § 8, point i). If the goods cannot be returned by normal post, we recommend Posten.no for more information and completion of the return of larger packages. If the consumer has expressly chosen a different type of delivery than this, this is a cost borne by the customer (cf. the Right of Cancellation Act § 24).
• The right of withdrawal requires that notice is given to the seller within 14 days after the delivery has been received. (cf. Right of Withdrawal Act § 21). The consumer must send the goods back without undue delay, and no later than 14 days from notification of the right of withdrawal having been given. (cf. Right of withdrawal § 25)
• The right of withdrawal gives the trader the right to charge the customer if the product has been affected and a reduction in value as a result of use is necessary to indicate the nature, characteristics and/or function of the product. (cf. Regarding the Court of Appeal § 25).
• The Act only applies to consumer purchases. The right of withdrawal cannot therefore be used by companies or others who have acted as part of business activities. (cf. Right of Withdrawal Act § 1).
• The Right of Cancellation Act does not apply to goods sold when the total contract sum, including shipping and additional costs that the consumer must pay, is NOK 300 or less. (cf. Section 2 of the Right of Cancellation Act).

In other words, you as a consumer have the right to withdraw from the agreement without giving any reason within 14 days after the service provider has fulfilled its obligation to provide information in accordance with the Right of Withdrawal Act and the goods and right of withdrawal form have been received, or after 1 year if information about the right of withdrawal has not been provided. Nevertheless, you will not regret the purchase of framing as each individual frame is manufactured separately for the consumer. There is no right of withdrawal for goods manufactured to the consumer's specifications, i.e. goods which are not prefabricated, and which are produced on the basis of the consumer's individual choices or decisions. Then you will regret the artwork but not the frame (cf. §52 of the Norwegian Purchase Act)

Right of withdrawal on posters, frames and personalized products

There is no right of withdrawal for goods manufactured to the consumer's specifications, i.e. goods which are not prefabricated, and which are produced on the basis of the consumer's individual choices or decisions. (cf. Purchase Act §52)

• Right of withdrawal or exchange does not apply to personalized posters, since they are printed to order.
• Right of withdrawal or exchange does not apply to framing as each individual frame is manufactured separately for the consumer.

How to return

Information about the return process

Contact customer service by e-mail and let them know that you want to cancel the purchase and why, and we will help you through the process. We will confirm/deny whether the order is within the criteria for the right of withdrawal. We will send you a return form which you must fill out. We would like to point out that it is the consumer who must bear the costs of returns. (cf. Section 15 subsection 1 of the Right of Appeal Act). It is encouraged that the right of withdrawal is sent as registered parcel post so that you can follow the package on Posten's pages so that you have a full overview of where the shipment is in the post office's system until it arrives at us. When we have received and processed your return, we will credit and refund your receivables depending on the payment method used.

Risk

When returning an item, the customer is responsible for the risk of return transport and can cover any costs in connection with return shipping. When exchanging an item, the customer is responsible for any costs in connection with return shipping.

Active handling

It obligates an active action* from you in such a way that there is no doubt that you make use of your right of withdrawal. With an active action, we can deal with the case in a fast and efficient way for both parties, according to the right of withdrawal act (* ref. the 14-day deadline mentioned in the right of withdrawal act § 11).

Passive handling

If you do not collect the order and are otherwise completely passive, this will not give us any indication as to why the package has not been collected. You will then not have met the requirements set for you in accordance with § 11 and § 13 of the Right of Withdrawal Act, and thus lose the right to withdraw from the agreement.

When the order is returned as undelivered, it will be credited in full and the goods returned to stock. We then issue a separate invoice with the value of postage to roads, plus an uncollected fee of NOK. NOK 300 to cover our handling costs. If the order is prepaid, we will offset this invoice against the credit note and in this way reduce the refund.

How to cancel the purchase if the order has not been sent?

If you have not received a shipment confirmation and wish to cancel the purchase, send an email to customer service and ask that the entire order be deleted. If one of these bodies confirms that the order has been deleted, you have regretted it. For your own part, it may be a good idea to see a copy of the e-mail and information about who you spoke to in connection with the fact that you regretted it for at least 14 days.

How do I cancel before the order is picked up at the delivery point?

Contact customer service by email and let them know that you want to use the right of withdrawal. You will receive an email confirming that the order is within the criteria for the right of cancellation. You do not need to take any action against the delivery location. When the order comes back to us it will be credited in full. A few days later, you will receive an invoice for postage one way (cf. Right of Cancellation Act § 15 first paragraph)

Complaint

If the goods received are faulty or missing, the buyer can exercise a number of rights of deficiency (e.g. withholding the purchase price, correcting redelivery, price reduction, withdrawal and compensation) in accordance with the Purchases Act, cf. cold §§30 et seq. However, this assumes that the buyer reacts within certain deadlines. In consumer purchases, the complaint deadline is based on the year after the buyer received the item. The seller must be notified within a reasonable time after discovering or having discovered the defect. There are no formal requirements for complaints, but for conscientious reasons the notification should be given in writing. It should be clear from the notification (complaint) which rights of deficiency the buyer wishes to assert. In the case of advertising, the service provider must bear all costs associated with the purchase, including the costs of return transport.

Examination of the item

When the buyer receives the item, it is recommended that he or she reasonably investigate whether it is in accordance with the order, whether it has been damaged during transport or whether it is otherwise missing. If it does not match the order or is missing, the buyer must notify the seller in the event of a complaint, cf. the contract's section on "Complaints in the event of defects and deadline for reporting claims in the event of delay".

Refund

When refunding an amount after canceling an order or using the right of withdrawal, the refund will only be made when:
• The amount is registered on our account or
• The product has been received in return and in the condition in which we sent the item
• If the item has been dispatched and/or delivered, the shipping cost will not be refunded unless there is a fault with the product or a fault with the delivery.

Art and VAT

VAT on art

There is VAT on art (which is not traded in the creator's own name). This is automatically calculated and included in the invoice amount when you shop with us. The fee is calculated according to the advance method cf. Section 4-5 of the Value Added Tax Act. This tax amount is not deductible as input tax, cf. regulation on bookkeeping § 8-10-4, and is then not specified on the invoice either.
For all other sales subject to VAT, including but not limited to framing, applied art, jewellery, specify the VAT amount on the invoice in a separate field.

Exemption from VAT for the artist's (author's) own sale of art

Several works of art in our range are marked with a "P", which means that these works of art are sold in the name of the creator and are distributed via Galleri Fint as an intermediary.

This type of turnover is exempt from VAT pursuant to section 3-7 (4) of the Value Added Tax Act (VAT): - The author's sales of own works of art and copyrights to own literary and artistic works are exempt from the law. The same applies to such turnover through an intermediary in the name of the originator.

For you as a customer, this means that you are shopping for the originator, who is then to be considered the counterparty to the contract, with Galleri Fint as an intermediary. For affected works of art, this will be specified on the invoice.

Any complaints about the works of art in the event of such sales are the responsibility of the author. Nevertheless, we have agreed with the originator and assist him in relation to the buyer, so that you need to deal with Galleri Fint.

Privacy and cookies

We collect and process personal data in order to be able to offer visitors to our websites the services and products they request. We also want to offer better and more relevant content to the individual customer, as well as create good and long-lasting relationships with our existing customers.

Note that all processing is based on consent, with the exception of the collection of data when purchasing, where certain information must be provided in order to complete the purchase. In this case, the processing basis is the conclusion of an agreement.
